Senators Kerry and Lugar Introduce "The StartUp Visa Act of 2011:"    

On March 15, 2011, Democratic chairman, John Kerry and Richard Lugar, a high ranking Republican on the Senate Foreign Relations Committee, introduced a bill that would allow foreign entrepreneurs, H-1B visa holders and students Legal Permanent Resident status, or as it is more commonly known as, a Green card, under one of three scenarios:

1) Foreign entrepreneurs who are able to find a U.S. investor and sponser who will invest at least $100,000 in their new venture, and after a two year period, their venture must have created at least five new jobs and have either raised over $500,000 in financing or generated more than $500,000 in annual revenue. 

2) H-1B visa holders or graduates from a U.S. university with degrees in certain disciplines, who can evidence an annual income in excess of $30,000 or assets in excess of $60,000 and have a U.S. investor who has invested at least $20,000 in their venture and after a two year period their venture must have created at least three new jobs and have either raised over $100,000 in financing or generated more than $100,000 in annual revenue.

3) Foreign entrepreneurs whose ventures abroad have generated at least $100,000 in sales from the U.S. and after a two year period their venture must have created at least three new jobs and have either raised over $100,000 in financing or generated more than $100,000 in annual revenue.

The 2012 H-1B Filing Season Opens on April 1, 2011:

April 1, 2011 marks the first day that H-1B applications can be filed for the October 1, 2011, employment start date. In 2008, the numerical cap of 65,000 was exceeded on April 1st, the very first day of filing. However, this past year the cap was not reached until the middle of January 2011.  


Secretary Napolitano unveils E-Verfiy Self Check:  

On March 21, 2011, Secretary of Home Land Security Janet Napolitano, along with the U.S. Citizenship and Immigration Services Director Alejandro Mayorkas, unveiled a new service for individuals which will allow them to check their own employment eligibility status before formally seeking employment. This service extends the existing E-Verify service, offered by USCIS, which allows employers to confirm information that employees submit on their I-9 Employment Eligibility Verification form.
